These Terms of Service (“Terms”) govern your access to and use of the InterviewMD platform, including our website, application, and all related services (collectively, the “Service”). Please read these Terms carefully before using the Service.
1. Acceptance of Terms
By creating an account, purchasing a Seasonal Pass, or otherwise accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.
If you are using the Service on behalf of an organisation (such as a school or tutoring company), you represent and warrant that you have the authority to bind that organisation to these Terms.
2. Service Description
InterviewMD is an AI-powered interview preparation platform designed for medical school applicants. The Service includes:
- AI-simulated mock interviews in MMI, panel, and other formats.
- Real-time AI-generated feedback and scoring on interview responses.
- Personalised AI coaching and improvement recommendations.
- Progress tracking, analytics, and performance history.
- Access to a library of interview scenarios and question banks.
The Service is a preparation tool and does not guarantee admission to any medical school or educational programme.
3. Eligibility & Access
To use the Service, you must be at least 16 years of age and have the legal capacity to enter into a binding agreement.
Access to InterviewMD is currently by invitation only. We reserve the right to accept, decline, or revoke invitations at our sole discretion. Receiving an invitation does not guarantee ongoing access if you breach these Terms.
We may limit the number of users per interview season to maintain service quality. Places are allocated on a first-come, first-served basis once an invitation is extended.
4. Account Registration
To access the Service, you must create an account by providing accurate and complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activity that occurs under your account, whether or not authorised by you.
- Notifying us immediately at hello@interviewmd.com if you suspect unauthorised access to your account.
Your account is personal and non-transferable. You must not share your account credentials with any other person or allow others to use your account.
5. Seasonal Pass & Payment
5.1 Seasonal Pass
Access to the full InterviewMD platform is provided through a Seasonal Pass priced at $497 USD (or the equivalent in your local currency at the time of purchase). The Seasonal Pass grants you:
- Unlimited access to all platform features for one interview preparation season (3 months from the date of purchase).
- Unlimited AI mock interview sessions.
- Full access to AI coaching, feedback, and progress analytics.
- Access to the complete scenario and question library.
5.2 Payment
Payment is processed securely through our third-party payment provider at the time of purchase. The Seasonal Pass is a one-time payment - there are no recurring charges or auto-renewals.
All prices are displayed in USD unless otherwise indicated. You are responsible for any applicable taxes, currency conversion fees, or charges imposed by your bank or payment provider.
5.3 Season duration
Each Seasonal Pass is valid for one interview preparation season, defined as 3 months (90 days) from the date of purchase. Your access start and end dates will be confirmed at the time of purchase. Access expires at the end of the 3-month period and does not carry over to a subsequent season.
6. Refund Policy
We want you to be confident in your purchase. Our refund policy is as follows:
- 14-day cooling-off period: if you purchased the Seasonal Pass directly through our website, you may request a full refund within 14 days of purchase, provided you have not completed more than 3 practice sessions. This is in accordance with the Consumer Contracts Regulations 2013.
- After 14 days: refunds are not available after the cooling-off period, as the Seasonal Pass provides immediate access to the full platform.
- Exceptional circumstances: if you experience significant technical issues that prevent you from using the Service, contact us at hello@interviewmd.com and we will work to resolve the issue or provide a proportional refund at our discretion.
To request a refund within the cooling-off period, email hello@interviewmd.com with your account email and purchase confirmation. Refunds are processed within 10 business days.
7. Acceptable Use
You agree to use the Service only for lawful purposes. You must not:
- Share, redistribute, or resell your account access, practice content, AI-generated feedback, or any part of the Service.
- Use the Service to generate content for commercial purposes or for the benefit of any third party without our written permission.
- Attempt to reverse-engineer, decompile, or extract the underlying AI models, algorithms, or source code.
- Use automated tools, bots, or scripts to access the Service or extract data.
- Upload or transmit any content that is unlawful, harmful, abusive, defamatory, or otherwise objectionable.
- Interfere with or disrupt the Service, its servers, or networks.
- Impersonate another person or misrepresent your identity or affiliation.
- Use the Service in any way that violates applicable laws or regulations.
We reserve the right to suspend or terminate your access without refund if you breach these acceptable use terms.
8. Your Content
8.1 Ownership
You retain ownership of all content you create or upload to the Service, including audio recordings of your interview responses, written answers, and any other materials you submit (“Your Content”).
8.2 Licence grant
By submitting Your Content to the Service, you grant InterviewMD a limited, non-exclusive, worldwide licence to store, process, and analyse Your Content solely for the purpose of providing and improving the Service for you. This licence terminates when you delete Your Content or your account (subject to our data retention policy).
8.3 What we don't do with your content
- We do not use Your Content to train general-purpose AI models.
- We do not share Your Content with other users.
- We do not sell or commercially exploit Your Content.
9. AI-Generated Content
The Service uses artificial intelligence to generate interview questions, feedback, scores, and coaching recommendations (“AI Content”). You acknowledge and agree that:
- AI Content is generated by automated systems and may contain errors, inaccuracies, or biases.
- AI Content is provided as a learning and preparation aid only. It does not constitute professional, medical, educational, or career advice.
- Scores and feedback are indicative and should not be relied upon as predictions of actual interview performance or admission outcomes.
- InterviewMD does not guarantee the accuracy, completeness, or suitability of any AI Content for your specific circumstances.
- You are solely responsible for how you use AI Content to inform your interview preparation.
10. Intellectual Property
The Service, including its design, code, AI models, question banks, content, logos, trademarks, and all other materials (excluding Your Content) are the intellectual property of InterviewMD Ltd or our licensors. All rights are reserved.
Your Seasonal Pass grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial interview preparation purposes during the applicable season.
You must not:
- Copy, reproduce, distribute, or publicly display any part of the Service without written permission.
- Remove, alter, or obscure any copyright, trademark, or proprietary notices.
- Use the InterviewMD name, logo, or branding without written permission.
11. Availability & Uptime
We strive to provide reliable access to the Service, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to:
- Scheduled maintenance (we will provide advance notice where possible).
- Unscheduled maintenance to address urgent issues.
- Factors beyond our reasonable control (force majeure).
- Third-party service outages affecting our infrastructure.
We are not liable for any loss or damage arising from service interruptions or downtime.
12. Limitation of Liability
To the fullest extent permitted by applicable law:
- The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory.
- We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
- InterviewMD does not warrant that the Service will meet your requirements, that results obtained will be accurate or reliable, or that the Service will be uninterrupted.
- In no event shall InterviewMD Ltd, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service.
- Our total aggregate liability to you for all claims arising from or related to the Service shall not exceed the amount you paid for your Seasonal Pass.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless InterviewMD Ltd, its directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your use of the Service.
- Your breach of these Terms.
- Your violation of any applicable law or regulation.
- Your Content or any other material you submit to the Service.
14. Termination
14.1 By you
You may stop using the Service and request account deletion at any time by contacting us at hello@interviewmd.com. Account deletion is subject to our data retention policy outlined in the Privacy Policy. Voluntary account deletion does not entitle you to a refund outside the 14-day cooling-off period.
14.2 By us
We may suspend or terminate your access to the Service immediately, without prior notice or liability, if:
- You breach these Terms.
- We reasonably believe your account has been compromised or is being used fraudulently.
- We are required to do so by law or regulatory authority.
- We discontinue the Service (with reasonable notice).
Upon termination for breach, you are not entitled to any refund. If we discontinue the Service, we will provide a pro-rata refund for any remaining unused portion of your Seasonal Pass.
14.3 Effect of termination
Upon termination, your right to use the Service ceases immediately. We will delete your account data in accordance with our Privacy Policy. Sections of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and governing law) will remain in effect.
15. Disputes & Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales.
If you have a dispute with us, we encourage you to contact us first at hello@interviewmd.com so we can attempt to resolve it informally. If we are unable to resolve the dispute, both parties agree to submit to the exclusive jurisdiction of the courts of England and Wales.
Nothing in these Terms affects your statutory rights as a consumer under applicable UK consumer protection law, including the Consumer Rights Act 2015.
16. Changes to These Terms
We may modify these Terms from time to time. When we make material changes, we will:
- Notify you by email or through a prominent notice on the platform at least 30 days before the changes take effect.
- Update the “Last updated” date at the top of this page.
Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and contact us regarding account closure.
17. General Provisions
17.1 Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and InterviewMD Ltd regarding the Service, superseding any prior agreements.
17.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
17.3 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision in the future.
17.4 Assignment
You may not assign or transfer these Terms or your rights under them without our written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets.
17.5 Force majeure
InterviewMD shall not be liable for any failure or delay in performing our obligations under these Terms caused by circumstances beyond our reasonable control, including natural disasters, pandemic, government action, power failures, internet disruptions, or third-party service outages.
